By accessing, using, or interacting with joingigatron.com, Gigatron, any associated Grok Bot, page, account, communication, points system, or reward (collectively, the "Service"), you agree to these Terms of Service ("Terms") in full. If you do not agree, do not use the Service.
The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any content, points, standings, or rewards are accurate, current, or reliable.
Nothing on the Service is, or should be construed as, financial, investment, trading, legal, accounting, or tax advice, a solicitation, an offer, or a recommendation to buy, sell, or hold any asset, token, security, or NFT. The Service is provided for entertainment and community-engagement purposes only. You are solely responsible for your own decisions and for obtaining independent professional advice.
Any points, ranks, leaderboard positions, badges, rewards, prizes, drops, or "surprises" are entirely discretionary, promotional, and provided for engagement only. They have no monetary or cash value, are not currency, securities, or financial instruments, are not redeemable for cash, and confer no ownership, equity, or legal right of any kind. We may create, modify, recalculate, reduce, revoke, suspend, withhold, or discontinue any points or rewards at any time, for any reason or no reason, without notice or liability. Rewards, if any, are never guaranteed and may be changed or cancelled at our sole discretion.
You represent that you are of legal age and legally permitted to use the Service in your jurisdiction. You agree not to misuse the Service, including by fraud, manipulation of points, spamming, unsolicited bulk messaging, impersonation, scraping, reverse engineering, or any unlawful or abusive activity. We may remove, restrict, or ban any participant at our sole discretion.
You use the Service entirely at your own risk and are solely responsible for any outcome, loss, or damage arising from your use. Digital assets, bots, and online communities carry inherent risks, including technical failures, volatility, and total loss. You assume all such risks.
To the fullest extent permitted by law, in no event shall Gigatron, joingigatron.com, their operators, affiliates, officers, employees, contractors, agents, or partners (the "Released Parties") be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, assets, or opportunities, arising out of or relating to the Service, whether based in contract, tort, negligence, strict liability, or any other theory, even if advised of the possibility of such damages. To the maximum extent permitted by law, the total aggregate liability of the Released Parties for any and all claims relating to the Service shall not exceed one hundred U.S. dollars (US$100), or the minimum amount required by applicable law if greater.
You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content or communications, or your breach of these Terms or any law or the rights of any third party.
The Service may reference or link to third-party platforms, bots, tokens, or content that we do not control and do not endorse. We are not responsible or liable for any third-party services, content, or conduct.
We may modify, suspend, or discontinue the Service or these Terms at any time without notice. Continued use after any change constitutes acceptance of the updated Terms.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration, and you waive any right to a jury trial or to participate in any class or representative action. If any provision is held unenforceable, the remaining provisions remain in full force.
These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior understandings. Our failure to enforce any provision is not a waiver.
